Eric Holder was referring to the standard of proof established in 1945 by the United States Supreme Court in Screws v. United States. Why Holder has waited until just before the clock strikes 12 on his tenure to raise this issue is mysterious. Just how does he plan to challenge a Supreme Court ruling in the short time he has left in office?
I wrote those words in 2015. As it turns out Eric Holder and the Obama Administration never made any effort to challenge the Screws ruling.
